Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of PM3K (the "Service"), operated by Nnamdi Okorafor ("PM3K," "we," "us," "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

PM3K is an AI-powered podcast production studio. You upload a raw recording (audio or video); the pipeline transcribes, edits, masters, and packages it into a publish-ready episode. A release gate pauses every episode before publication so you review and approve it. The Service does not publish without your approval, and a hard quality-control failure blocks publication outright.

3. Accounts & Eligibility

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
• You are responsible for safeguarding your credentials and for all activity under your account.
• You agree to provide accurate account information and keep it current.

4. Your Content

• You retain all rights to the recordings and other content you upload ("Your Content").
• You grant us a limited, non-exclusive license to process, host, transcribe, and store Your Content solely to provide the Service to you.
• You represent that you have all rights necessary to upload Your Content, including the consent of any guests or third parties whose voice, image, or likeness appears in it.
• We do not claim ownership of your finished episodes. When you approve an episode for publication, you are responsible for ensuring it does not infringe any third party's rights or violate any law.

5. AI Outputs & Accuracy

Parts of the Service use artificial intelligence (transcription, editing, show notes, fact-checking). AI outputs may be inaccurate or incomplete. The Service flags unverifiable claims rather than inventing citations, but you are solely responsible for reviewing all AI-generated content before publishing it, including any medical, legal, financial, or factual statements.

6. Fees, Billing & Refunds

The Service is currently offered on a free or beta basis. When paid plans are introduced, pricing and billing terms will be posted on the pricing page and incorporated into these Terms by reference. Fees are non-refundable except as required by law, unless a specific refund policy is stated at purchase.

7. Acceptable Use

You agree not to use the Service to:

• Upload or publish content that is unlawful, defamatory, infringing, or that violates another's privacy or publicity rights;
• Impersonate any person or misrepresent your affiliation;
• Upload malicious code, or attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
• Use the Service to generate deceptive media in violation of applicable law.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination, you may export Your Content during a 30-day grace period, after which it may be deleted.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall PM3K be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the greater of the amount you paid us in the twelve (12) months preceding the claim or one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless PM3K and its personnel from any claims, damages, or expenses arising from Your Content or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Pinellas County, Florida.

13. Changes

We may update these Terms from time to time. Material changes will be communicated via email or in-product notice. Continued use after the effective date constitutes acceptance.
